Terms & Conditions of Membership


These terms and conditions (the “Conditions”) govern your Rent it Here membership and your use of the rentithere.co.uk website (the "Website") and the in-store Rent it Here unit (the "Unit"). By applying to become a Rent it Here member or by accessing the Website or by using the Unit, you acknowledge and agree that you are bound by these Conditions.
Rent it Here is operated by Blue Chip Data Ltd, Repton House, Bretby Business Park, Bretby, Burton-On-Trent, DE15 OYZ (trading as Rent it Here), a company registered in England and Wales whose registered office is at 68-74 Carlton Road, Worksop, Nottinghamshire, S80 1PH.  All references to "We", "Us" or "Our" in these Conditions are to Blue Chip Data Ltd.


1 Membership


1.1 You may apply for membership via the Website, by telephone or at any participating Rent it Here store.
1.2 The minimum requirements for membership are as follows:
       1.2.1 You must be at least sixteen (16) years old and be resident in the United Kingdom (including Northern Ireland).
       1.2.2 You must provide Us with the following information:
               • Your name;
               • Your email address, phone number (if you apply for membership via the Website, you must provide your email address); and
               • Your postal address.
1.2.3 You must provide Our in-store representative with one of the items of identification specified on the Website or the Unit.
1.3 We may refuse any application for membership, if We consider this appropriate.
1.4 We will provide you with a membership card in one of the following ways:
        • If you have applied online, you may collect your membership card from any participating Rent it Here store;
        • If you have applied in-store, Our in-store representative will give you your membership card; and
        • If you have applied by telephone, We will send you your membership card by post.
1.5 You will inform Us as soon as possible of any change to the information provided in accordance with Condition 1.2.2.
1.6 If We discover that you have provided Us with any information that is incorrect or out of date, We will be entitled to terminate your membership immediately and Condition 8.3 will apply.

2 Issue of DVDs


2.1 You may reserve a DVD either via the Website or by means of the Unit. While We endeavour to provide accurate information of stock at participating Rent it Here stores, We do not guarantee that any DVD reserved via the Website or the Unit will be available for collection.
2.2 If you reserve a DVD online,  We will keep the DVD for you to collect for one hour after you have reserved it.
2.3 If you reserve a DVD by means of the Unit, We will keep the DVD for you to collect for one hour after you have reserved it.
2.4 DVDs are issued by Our in-store representative at the store specified on the Website or Unit at the time you reserve them. We will only issue DVDs to Rent it Here members.
2.5 The amount due and the rental period for each DVD will be the amount specified on the Website or Unit at the time you reserve it. You may pay the amount due for the relevant rental period either online or by giving payment to Our in-store representative.
2.6 All rental periods for DVDs will be calculated as follows: one day's rental is from the point of rental until the closing time on the following day of the store that issued the DVD (or, if you return the DVD to a store other than the one that issued the DVD, the closing time on the following day of the store to which you return the DVD).
2.7 In order to be issued with a DVD, you must first:
       • Reserve the DVD, either via the Website or on the Unit;
       • Present your membership card to our in-store representative; and
       • Pay Us the correct amount payable for the DVD for the period you have reserved it, either via the Website or Our in-store representative.
2.8 All DVDs are Our property and you will not own them at any time.
2.9 If any DVD We provide you is defective or damaged at the point of issue, you should return it immediately in the condition it was issued to you to the store that issued the DVD [and We will give you a full refund].
2.10 You may borrow up to four (4) DVDs at any time.
2.11 You may only reserve or take out on loan any DVD which you are eligible to view in accordance with the classification applied to it by the British Board of Film Classification.
2.12 We reserve the right not to issue you any DVD, if We consider this appropriate.

3 Use and Care of DVDs


3.1 Once you have been issued a DVD by Our in-store representative, you will be responsible for the DVD (including any sleeve and packaging) until you return it to the store which issued you the DVD.
3.2 You will maintain the DVD securely and in good condition and will follow any instructions we provide on the storage and maintenance of the DVD.
3.3 You will use the DVDs only for your personal and private use and not for any direct or indirect commercial purpose.
3.4 You will not part with possession (or attempt to part with possession) of any DVDs while they are on loan to you, whether by selling, lending, charging them or otherwise, and you will not do anything that infringes our rights of ownership of the DVDs.
3.5 You will be responsible for any viewing of a DVD on loan to you. You will ensure that any DVD on loan to you will only be viewed in accordance with any classification applied to it by the British Board of Film Classification.
3.6 If a DVD is lost, stolen or damaged while on loan to You,
      • You will inform Us immediately by contacting the store which issued the DVD (and, if appropriate, return it immediately to the store    which issued the DVD); and
      • We may charge You up to the full replacement cost (in addition to any other charges that may be due relating to your loan of the DVD).


4 Return of DVDs


4.1 You will return the DVD within the period specified when you reserved it and for which you have already paid the relevant amount.
4.2 You may return a DVD to any participating Rent it Here store. Unless We inform you otherwise, you may not return a DVD in any other way.
4.3 If you fail to return a DVD in accordance with Condition 4.1, We may charge you Our daily penalty rate. If you have still failed to return a DVD [ten (10)] days after it is due, We will be entitled to charge you the full replacement cost in addition to any other amounts payable by you to Us.
      • The current daily penalty rate is £1 for New & Top Releases and 50p for older titles
      • The current replacement cost is £15 (payable by Cheque)


5 Use of the Unit


5.1 You may not tamper with the Unit or use it in any way which is likely to cause it damage.
5.2 We can give no guarantee and make no representations or warranties of any kind in relation to the data made available via the Unit, including whether such data is accurate, complete or up-to-date. We are not liable or responsible for any errors or omissions in the data on the Unit, and We do not represent or warrant that the information accessible via the Unit is accurate, complete or up-to-date.


6 Use of the Website

6.2 We can give no guarantee and make no representations or warranties of any kind in relation to the content of the Website, including whether such content is accurate, complete or up-to-date. We are not liable or responsible for any errors or omissions in the content of the Website, and We do not represent or warrant that the information accessible via the Website is accurate, complete or up-to-date.


7 Intellectual Property Rights


7.1 You will not infringe any rights, including intellectual property rights, of any person, including copying, reproducing, screening, republishing or otherwise modifying the DVDs, and will not be involved in piracy of any kind.
7.2 You will comply with the terms of any copyright notice displayed on any DVD or on its sleeve, packaging or contents. You may not use the DVD in a manner inconsistent with the rights of the copyright owners, and you may not commercially exploit any DVDs in any way.
7.3 If you fail to comply with Condition 7.1 and/or Condition 7.2, you will reimburse Us in full for the costs, expenses and damages We incur as a result of your failure to comply with Condition 7.1 and/or Condition 7.2.


8 Cancellation of Membership


8.1 You may cancel your membership at any time, provided that there are no DVDs on loan to you and there is no amount owing from you to Us. You may cancel your membership [either at a participating Rent it Here store or] by contacting Us in either of the following ways:

8.2 We may cancel your membership immediately and without notice if you fail to comply with any of these Conditions. If We cancel your membership pursuant to this Condition 8.2:
8.2.1 You will return any DVDs out on loan to you and repay any amounts you owe Us in full within [seven (7) days after We have informed you that your membership has been cancelled]; and
8.2.2 If [seven (7) days] have passed [after We have informed you that your membership has been cancelled] and We have not received any DVDs out on loan to you, We will charge you the full replacement cost.
8.3 We may cancel your membership at any time without cause. If We cancel your membership in accordance with this Condition 8.3:
8.3.1 You will return any DVDs on loan to you and repay any amounts you owe Us in full within [twenty eight (28) days after We have informed you that your membership has been cancelled]; and
8.3.2 If [twenty eight (28) days] have passed [after We have informed you that your membership has been cancelled] and We have not received any DVDs out on loan to you, We will charge you the full replacement cost

9 Rent it Here (a trading name of Blue Chip Data Ltd ) recognises that your privacy is very important to you and that it is your right to control your personal information. We know that providing personal information is an act of trust and we take that trust seriously. Rent it Here will never sell, rent or, except as set out in this Privacy Policy, otherwise disclose any of your personal information, including your Email address, to any third party without your consent. Unless you give us specific consent to act otherwise, the following policies will govern how Rent It Here handles the personal information that you provide to us.

9.2 Collection and use of information
If you do not register as a Member of Rent It Here, the information we collect from you is limited. We log your IP address in order to help diagnose problems with our servers, administer this Website and track usage statistics. Your IP address may vary each time you visit, or it may be the same, depending on the type of internet connection. Either way, it would be extremely difficult for us to identify you through your IP address, and we make no attempt to do so. If you reach this Website by clicking on a link or advertisement on another website, then we also log that information. All of this information is collected and used only in aggregate; that is, it entered into our database, where we can use it to generate overall reports on our visitors, but not reports about individual visitors.
If you choose to register as a Member of Rent It Here, you will be able to take advantage of all of the features of this Website or Unit in Store. Rent It Here collects some or all of the personally identifiable information set out below when you subscribe to the Rent It Here service register as a Member of Rent It Here, when you access and use this Website and/or when you use Rent It Here's products and/or services.


9.3 What we collect:

• Mobile telephone number (optional)
• Date of Birth (for members under 16 – 18)


9.4 How we use it
• To check that a payment card is valid
• To pay your account
• To provide you with outstanding payment information
• To recommend other DVDs you may like to rent;
• To communicate with you regarding your Rent it Here Membership and the services we provide you;
• To provide you with your membership and payment information;
• To establish rental trends in order to recommend other DVDs you may like to rent;
• To process and respond to requests, enquiries and complaints received from you;
• To provide services requested by you;
• To update our records;
• For audit purposes;
• To carry out customer satisfaction research;
• To prevent or detect fraud;
• To enable third parties, including any of our group companies, to carry out any of the purposes above on our behalf.
• To send you samples of, or marketing materials relating to, third party products or services which we believe may be of interest to you. Such materials may accompany the discs you have selected to rent, or may be sent by us separately. Please note that at no time is it necessary for us to provide your personally identifiable information to third parties in order to send you these materials
• To improve services and enhance personalisation, we may periodically obtain information about you from other third party sources from whom we have lawfully obtained this data and add it to your registration information. Additionally, authorised Rent It Here personnel may update your registration information to accurately reflect any new information included in any communications received from you.


9.5 Communication Preferences
If you do not want to receive emails from us with offers, news and information, you can change your contact preferences at any time in the “Edit my Details” area of your “My Account” page.
9.5.1 Opt in / Opt out
As a customer of Rent It Here you can receive our free email messages or SMS messages and get exclusive, tailored product offers and deals based on your preferences, browsing behaviour rental selections you make from Rent it Here, its branded and affiliated websites and companies.
If you do not wish to receive these emails you have the option to opt out at any time by unsubscribing from these email  or tick the box on submitting the registration form.

9.6 Information storage


All information you provide to us is stored in the UK only on secure servers that are protected in secure facilities including firewall protection and located in those countries that form part of the European Economic Area or are considered to provide adequate protection for personal information under the European Union Data Protection Directive (95/46/EC).


9.7 Cookies


'Cookies' are small text files that are stored by the browser on your computer. Websites are able to read and write these files, which allows them store things like personalisation details and user preferences. We use cookies for a number of purposes, including to:
• recognise you as a Rent It Here member so that we can log you in to this Website on a repeat visit;
• provide you with customised content and remember preferences you specify while you are using our products or services;
• deliver advertisements relevant to your interests when you visit our Website and use our products and services;
• provide general internal and customer analytics to conduct research to improve our Website and our products and services; and
• support security measures such as requiring re-logging into this Website after a certain amount of time has elapsed.

Rent It Here is committed to protecting your personal information. We will not disclose your personally identifiable information to third parties without your consent except:
• where Rent It Here is required by law to disclose information to third parties;
• where the disclosure is necessary for the performance of our operations (e.g. mail delivery, hosting services, or protecting us from fraud); or
• Rent It Here buys or sells subsidiaries or business units in connection with a corporate transaction, such as a sale, merger, consolidation or asset sale, or an internal reorganisation, or in the unlikely event of an insolvency. If such a transaction or event required the transfer of customer information, then that information would be one of the transferred assets, but would remain subject to the commitments made in any pre-existing Privacy Policy or equivalent.
We also may share your personal information with third parties specifically engaged by Rent It Here to provide services to us, in which case we will require those parties to keep that information confidential and secure and to use it solely for the purpose of providing the specified services to us.
Companies and individuals registered in the Rent It Here Affiliate Program receive aggregate information about customers that they direct to Rent It Here through links on their websites. No personally identifiable information is provided to affiliate members; the information collected from our affiliates is used strictly for the affiliates program and will not be used for general marketing purposes.
Please note that you have certain rights under the Data Protection Act 1998. You have the right to be told what personal information we hold about you, to correct errors in that information and to prevent Rent It Here from using your personal information for direct marketing purposes. 9.10 Security and prevention against loss, misuse or alteration of information


Rent It Here has implemented technology and security features, as well as strict internal guidelines, to safeguard the privacy of your personal information from unauthorised access or improper use. We will continue to enhance our security procedures as new technology becomes available

9.11 Your ability to edit and cancel your account
You can access "My account" section from every page on our Website to update and correct the personal details that we gathered when you subscribed registered. You must be logged in to access this information. All information is password-protected so no one can access the information but you.
If you decide to cancel your Rent It Here subscription, your account will be deactivated immediately once we have received back all the discs that you have rented. However we are required to retain your information for accounting and taxation business, operational and administrative purposes and in accordance with applicable laws.


9.12 Changes to this Privacy Policy
From time to time, Rent It Here will review and may edit this policy in accordance with potential changes to our business and as required by law. Rent It Here reserves the right to change its Privacy Policy at any time. This Privacy Policy may be amended in accordance with paragraph 1.2 of our Terms and Conditions (of which this Privacy Policy forms part).

10 These Conditions
10.1 Any terms and conditions, additional usage rules or similar which are included on the Website, the Unit, or any DVDs We issue you (including their sleeves, packaging and any contents) are deemed to be incorporated into these Conditions.
10.2 We may change these Conditions at any time. The Conditions applicable to your use and/or purchase of Our products and services will be the version that is current and displayed on the Website or Unit as at each date you use the Website or Unit and/or use or purchase Our products and services. Your use of the Website or Unit or your use or purchase of Our products and services after changes have been made means that you agree to be bound by these changes.

11 Fees and Charges


11.1 We may change the fees and charges, or add new fees and charges, for any of Our products and services at any time.  If you do not agree with any change or addition We make to Our fees and charges, you may cancel your membership in accordance with Condition 8.1.


12 Promotions
12.1 Any promotional code or offer We provide, whether on the Website or the Unit or otherwise, cannot be used in conjunction with any other promotional code or offer, past or present.


13 General
13.1 We may assign, subcontract and/or transfer any of Our rights or obligations under these Conditions to any third party.
13.2 Your Rent it Here membership and your rights and obligations under these Conditions are personal to you and you may not transfer them (in whole or in part) to any third party.
13.3 We will not be liable to you for any lack of performance, or the unavailability or failure or the Website or the Unit or for any failure or delay by Us to comply with these Conditions where this lack, unavailability or failure arises from any cause beyond Our reasonable control.
13.4 No delay or failure by Us in enforcing any of Our rights under these Conditions shall constitute a waiver or prejudice Our right under these Conditions (or any other right or remedy), nor shall any single or partial exercise of any right or remedy preclude the further exercise of that or any other right of remedy.
13.5 Unless expressly stated in these Conditions, nothing in these Conditions shall confer any right on any person under the Contracts (Rights of Third Parties) Act 1999.
13.6 These Conditions (including any other terms and conditions or usage rules incorporated into these Conditions constitute the whole agreement between you and Us in connection with their subject matter. These Conditions supersede any prior agreement, representation or other statement, whether written or oral relating to the subject matter of these Conditions. Neither We nor you have any liability to each other for a representation or statement not set out in these Conditions.
13.7 These Conditions are to be governed by English law and the English courts.
13.8 If any of these Conditions (or part of a Condition) is held to be invalid, unenforceable or illegal under the laws of any jurisdiction, the Condition shall apply with whatever modification is necessary to give effect to the commercial intention of the parties or, at Our discretion, it may be removed from these Conditions and the validity, enforceability or legality of the other Conditions will not be affected.
